Time bomb: Military ordnance in Gulf of Mexico poses threat to shipping, says expert

ScienceDaily (Sep. 28, 2012) ? Millions of pounds of unexploded bombs and other military ordnance that were dumped decades ago in the Gulf of Mexico, as well as off the coasts of both the Atlantic and Pacific oceans, could now pose serious threats to shipping lanes and the 4,000 oil and gas rigs in the Gulf, warns two Texas A&M University oceanographers.

William Bryant and Neil Slowey, professors of oceanography who have more than 90 years of combined research experience in all of Earth's oceans, along with fellow researcher Mike Kemp of Washington, D.C., say millions of pounds of bombs are scattered over the Gulf of Mexico and also off the coasts of at least 16 states, from New Jersey to Hawaii.

Bryant says the discarded bombs are hardly a secret. "This has been well known for decades by many people in marine science and oceanography," he explains.

He will give a presentation in San Juan, Puerto Rico on Oct. 1 about the bombs to a group of oceanographers and marine scientists in a conference titled "International Dialogue on Underwater Munitions."

"This subject has been very well documented through the years," Bryant explains. "My first thought when I saw the news reports of the Deepwater Horizon explosion in the Gulf two years ago were, 'Oh my gosh, I wonder if some of the bombs down there are to blame.'"

Military dumping of unused bombs into the Gulf and other sites started in 1946 and continued until 1970, when it was finally banned.

Millions of pounds -- no one, including the military, knows how many -- were sent to the ocean floor as numerous bases tried to lessen the amount of ordnance at their respective locations.

"The best guess is that at least 31 million pounds of bombs were dumped, but that could be a very conservative estimate," Bryant notes.

"And these were all kinds of bombs, from land mines to the standard military bombs, also several types of chemical weapons. Our military also dumped bombs offshore that they got from Nazi Germany right after World War II. No one seems to know where all of them are and what condition they are in today."

Photos show that some of the chemical weapons canisters, such as those that carried mustard gas, appear to be leaking materials and are damaged.

"Is there an environmental risk? We don't know, and that in itself is reason to worry," explains Bryant. "We just don't know much at all about these bombs, and it's been 40 to 60 years that they've been down there."

With the ship traffic needed to support the 4,000 energy rigs, not to mention commercial fishing, cruise lines and other activities, the Gulf can be a sort of marine interstate highway system of its own. There are an estimated 30,000 workers on the oil and gas rigs at any given moment.

The bombs are no stranger to Bryant and Slowey, who have come across them numerous times while conducting various research projects in the Gulf, and they have photographed many of them sitting on the Gulf floor like so many bowling pins, some in areas cleared for oil and gas platform installation.

"We surveyed some of them on trips to the Gulf within the past few years," he notes. "Ten are about 60 miles out and others are about 100 miles out. The next closest dump site to Texas is in Louisiana, not far from where the Mississippi River delta area is in the Gulf. Some shrimpers have recovered bombs and drums of mustard gas in their fishing nets."

Bombs used in the military in the 1940s through the 1970s ranged from 250- to 500- and even 1,000-pound explosives, some of them the size of file cabinets. The military has a term for such unused bombs: UXO, or unexploded ordnance.

"Record keeping of these dump sites seems to be sketchy and incomplete at best. Even the military people don't know where all of them are, and if they don't know, that means no one really knows," Bryant adds. He believes that some munitions were "short dumped," meaning they were discarded outside designated dumping areas.

The subject of the disposal of munitions at sea has been discussed at several offshore technology conferences in recent years, and it was a topic at an international conference several years ago in Poland, Bryant says.

"The bottom line is that these bombs are a threat today and no one knows how to deal with the situation," Bryant says. "If chemical agents are leaking from some of them, that's a real problem. If many of them are still capable of exploding, that's another big problem.

"There is a real need to research the locations of these bombs and to determine if any are leaking materials that could be harmful to marine life and humans," Bryant says.

Ga. law enforcement agencies seek military vets

ATLANTA -- Law enforcement agencies in Georgia are looking for military veterans.

The state Department of Corrections is hosting a military personnel job fair Wednesday at State Offices South at Tift College in Forsyth. The agencies have approximately 800 jobs available for military personnel returning from duty.

Participating agencies include: the State Board of Pardons and Paroles, the Department of Corrections, the Department of Juvenile Justice, the Department of Public Safety, the Department of Natural Resources and the Georgia Bureau of Investigation.

The job fair is set to include an orientation with guest speakers presentations of the participating agencies.

The event is free and open to U.S. Veterans who register online.

Oregon vs. Washington State: Ducks Can Turn It on at Will, but Is That Bad?

The Oregon Ducks, after a slow start, were able to put their foot on the gas and explode past yet another Pac-12 opponent on Saturday.

As it stands right now, there is no team in the nation that has the uncanny ability to flip a switch at the half, come out and absolutely demolish the opposition quite like Oregon. It's a tremendous quality to have and while the slow starts are worrisome to some folks, the Ducks' unique ability is not a bad thing. At least not yet.

Every team makes adjustments at halftime; earlier today we saw South Carolina trail Kentucky 17-7 at the break and then come out to win 38-17. However, the chasm between merely adjusting to opponents and turning it on full blast is where Oregon sets itself apart from the field.

Against Arizona the Ducks were up just 13-0 and the Wildcats thought they had a game on their hands. 30 minutes later it was 49-0 and Oregon had their backups in the game getting reps.

Saturday night the media darling that is Mike Leach had the Washington State Cougars down just four at the half,? trailing Oregon 23-19 and looking to get after it in the second half. What would take place in the next 30 minutes would be anything but the Cougs "getting after it." Oregon put the blitz on Leach's team, scoring a barrage of touchdowns that gave one of the nation's premier offenses a 51-26 victory.

Oregon is like a boxer. They spend the first part of the game feeling their opponents out, looking for holes and checking for weaknesses. They get a feel for both sides of the ball and for how their opponent wants to attack them.

Then, they go back to their corner, alter their strategy and come out swinging for the knockout. The Ducks hit their opponent again and again and again, until they're punchdrunk by the end of the third quarter and still have 15 minutes to go.

This is not just an offensive beating; the Ducks' defense tightens like a noose around their opponent's neck.

Saturday, Mike Leach's offense that appeared dangerous in the first half could only muster a touchdown in garbage time against Oregon's continually improving defense. Nick Aliotti's defense is getting pressure with their linemen, playing sound coverage and taking advantage of the other team's mistakes.

  • No, Oregon is good enough to come back against anyone.

Oregon's moves to feel things out and make adjustments is going to work for the bulk of their schedule. Simply put, they are just better than most of the Pac-12 by a good measure. For the games where they will face tougher competition, turning it on after the half could be a problem.

But that's only if they do not recognize the issue.

Slow-playing it against USC or Stanford could lead to a halftime deficit that could prove to be insurmountable. After the way last season's USC contest progressed, Ducks down 21-7 at the half, expect Oregon to approach those games with a different plan.

We saw this in the Rose Bowl where they pushed early to match Wisconsin at every turn, eventually outdueling the Badgers for the 45-38 victory.

So while the ability to flip the switch after halftime could be damning, this Oregon Ducks team, players and staff, understand that all games?and, more importantly, all opponents?are not created equal.

Much like Chip Kelly spent his pre-conference season getting Marcus Mariota accustomed to passing the ball, he is using lighter conference opponents to tweak and perfect his approach. As long as Oregon recognizes when it might be in trouble, the feeling-out strategy is going to work, and the Ducks will be quite alright.?

5 Mobile Photographers Capturing the World With Android

With advances in smartphone technology and camera resolution, it's now easier than ever to capture quality images with the mobile device you carry everywhere. The rise of photo editing apps has added to this movement toward mobile photography, which is becoming a burgeoning and reputable art form.

It may seem like iPhone users, or "iPhoneographers," dominate this art form, but there's a sizeable "Androidographer" community as well, especially on platforms like Google+, Instagram and Flickr.

We spoke to five photographers who use their Android devices -- exclusively or in addition to other cameras -- to shoot, edit and share beautiful photos, and they offered some advice for those looking to enter the field.

1. Linda Stokes

Linda Stokes uses a Samsung Galaxy III for nearly every shot she takes, but she has a backup phone for emergency situations -- for instance, if her battery dies and she's capturing a special moment, such as a wedding.

"Shooting with my Droid is my favorite thing to do with my clothes on," Stokes says. She finds her Android device, with its camera and sharing capabilities, to be a perfect immediate art form. "The more pictures I took, the more I saw what could be achieved, and the more I liked it," she says.

Stokes enjoys shooting nature -- waterscapes, flowers, sunrises and sunsets -- as well as anything she sees during the day with an interesting light or unusual aspect. "My Android device inspires me with its versatility ... and absolutely beautiful color and results," she says.

Stokes mentions that mobile photographers should make shooting with their phones a habit, or a ritual -- that way, it will "quickly, almost automatically, become one of your favorite art forms."

2. Katie Cowden

When Katie Cowden isn't photographing her daily progress on whichever textile art project she's working on, she uses her T-Mobile myTouch Slide to capture whatever catches her eye. With the help of editing apps like Vignette and Instagram, she particularly likes to photograph graffiti, architecture and the people around her.

"I use my Android because it fits in my pocket or purse in a way a DSLR just doesn't," she says. "Not having a million settings forces me to think about the photo in a different way."

Cowden advises mobile photographers to make sure the lens is always clean, and to always be on the lookout for natural light. "Since the camera phone is not very adjustable, I try to start out with good lighting so I can focus on framing and composition," she says.

3. Donny Tidmore

Out of the 10 photography apps Donny Tidmore has on his Samsung Galaxy S II, he consistently uses three to edit his photos: Vignette, Little Photo and Pixlr-o-matic. He doesn't use Instagram for editing -- only as a social network to share his art.

For Tidmore, the benefit of using an Android device extends past its convenient size -- he likes that everything is maintained on one device. "It's being able to do all of my editing, and upload [photos] to a social network, all on my phone no matter where I am," he says. "I have a job where I'm out and about all day, and being able to create on my phone while I should be working is awesome."

His main piece of advice for mobile photographers? Experiment with apps. "There is no shortage of photography apps in the App Store or Google Play. Spend a lot of time working with different ones until you find your 'style' or something that really clicks with you," he advises. "Other than that, shoot often ... and have fun!"

4. Fran?ois-Ren? Hamelin

Even though Fran?ois-Ren? Hamelin owns a Canon PowerShot G11 and a Canon EOS 7D -- both high-quality DSLRs -- he uses his Android HTC Desire HD with Ice Cold Sandwich (Android v 4.0.4) for mobile photography. The fact that he always has his smartphone with him makes it his main tool for taking pictures.

Hamelin uses editing apps like UCam Ultra Camera (which allows him to focus easier) and Pixlr-o-matic for filters. The HTC Desire also includes camera software that creates panoramic photos.

"I always try to have pictures that tell stories or at least that give a feeling," Hamelin says. "All my pictures taken with my smartphone are made to be seen by my friends that live far away from me [in Belgium], so I try to put what I feel inside."

Hamelin suggests that fellow mobile photographers "look everywhere, shoot, move, shoot again -- the more you take pictures, the more you find what works and what does not."

5. Jaina Mistry

Like Tidmore, Jaina Mistry uses her Samsung Galaxy S II for photography, documenting the world around her. Her go-to editing app is Vignette for the filters, as well as the basic editing tools such as brightness, contrast, saturation and temperature.

"Convenience is the biggest factor," Mistry says. "I have my phone on me all the time, and it has a pretty good camera attached to it. I do usually carry my DSLR around with me, too, but sometimes it's just quicker to get that snapshot with my phone." She explains that being able to share her photos instantly is another reason why her smartphone's camera comes in handy.

Mistry is an advocate for editing photos, but she advises mobile photographers to be smart about it.

"I know there's a lot of backlash against filters on your photos, and I can understand [that] backlash," she says. "Which is why I say use filters, but don't abuse filters. Don't feel the need to add a filter if your photo doesn't need it. Sometimes a photo is perfectly brilliant without a filter over the top of it."

Bergeron's late TD lifts No. 12 Texas 41-36

STILLWATER, Okla. (AP) ? The reasons to doubt David Ash continue to vanish as he keeps finding ways to lead No. 12 Texas to victory.

Ash threw three touchdown passes to Jaxon Shipley and set up Joe Bergeron's 2-yard touchdown run with 29 seconds left in the Longhorns' 41-36 victory over Oklahoma State on Saturday night.

Ash led Texas (4-0, 1-0 Big 12) on a 75-yard scoring drive after the Cowboys (2-2, 0-1) took the lead on Quinn Sharp's 24-yard field goal with 2:34 to play.

Ash connected with tight end D.J. Grant for a 29-yard pick up on fourth-and-6 to keep the drive going, and Mike Davis outleaped Justin Gilbert on a 32-yard deep ball to set up Bergeron's winning touchdown.

"He will not be under any more pressure than this, and he couldn't have done this this time last year," said coach Mack Brown, who moved to 7-0 in Stillwater. "He has really grown up. He is the leader of this football team."

J.W. Walsh started in place of injured Oklahoma State quarterback Wes Lunt and threw for 307 yards and two touchdowns.

Joseph Randle added a career-high 199 yards rushing and two touchdowns for the Cowboys, who hung a banner marking last season's Big 12 championship in the east end zone but started their defense of it by coming up short in a wild fourth quarter that featured four lead changes.

The Longhorns had lost at home to OSU each of the past two seasons. Last season, Ash was making his first career start and threw for only 139 yards with two interceptions and no touchdowns in a 38-26 loss.

"That game really haunted me because as a first start, it wasn't the first start that you wanted to have," said Ash, who finished with 304 yards passing and threw his first interception of the season.

"This game kind of means a lot."

D.J. Monroe added a 100-yard kickoff return touchdown as the Longhorns improved to 23-4 in a series in which they have rallied from 28-, 19- and 21-point deficits just since 2004. This was another difficult one for Oklahoma State to take.

Randle lunged in from 2 yards out to put Oklahoma State up 33-28 early in the fourth, only for Texas' potent running game to come alive next. Bergeron also capped that 75-yard drive with a 1-yard touchdown run, as the Longhorns picked up 65 yards on seven carries while moving down the field.

After the ensuing kickoff went out of bounds, Oklahoma State needed just three plays to bolt to the Texas 13. But then that drive stalled, with three straight 2-yard runs ? two by third-stringer Desmond Roland and then one by Randle, who was pulled out for a breather ? and the Cowboys settled for Sharp's field goal.

"Coaches will have second thoughts about plays that were called. ... We have to be able to make those plays and get that stop," Gundy said.

Bergeron's scoring run was reviewed on instant replay after Oklahoma State safety Daytawion Lowe came out of the pile with the ball in the end zone, but officials upheld the call on the field.

"They made a play at the end and they happened to make a play when the clock ran out," Gundy said. "Give them credit."

Settling into his starter's role after splitting time with Case McCoy last season, Ash also threw scoring passes of 44 and 20 yards to Shipley in the first half before the pair hooked up for a 7-yard TD on a fade pass in the third quarter to make it 28-20.

"It's something we haven't been able to do in the last couple years, win a tough game like this on the road," Brown said.

The Longhorns had a losing record in Big 12 play each of the past two seasons after winning the conference championship in 2009.

"The only thing that was important for us tonight was to win," Brown said. "We needed to go on the road, we needed to win against a team that had beaten us twice in a row, we needed to win against a team that had won more games than anybody in the Big 12 the last two years and we needed to win at a place where they hadn't lost for the last two years."

Texas had only 29 yards on its first 22 rushing attempts but gained 106 on its last 20 tries during crunch time. Oklahoma State ran for 275 yards but couldn't punch it in its last time in the red zone.

"It comes down to just your will," said Bergeron, who had 48 yards on 15 carries. "It's not the play, it's the player. It comes down to just how you play, not the scheme. It's just how bad you want it. At the end of it, I felt like we just wanted it more."

Walsh threw a 20-yard TD pass to John Goodlett in the third quarter and a 44-yarder to former high-school teammate Josh Stewart in the first half.

"When the coaches draw plays up, we've got to execute them as best we can," Walsh said. "When we do, we're successful. And when we don't, we're not. I think as a whole we played really well tonight."

Debt Management Strategies For Fall

Last week marked the first day of Fall, which means that we are headed towards one of the favorite times of the year; the holiday season. While many people anticipate the holidays for family gatherings and gift giving, less than one-third of us will anticipate the money to be spent during this time. Rather than end up further in credit debt, consider planning for your holiday spending.

We aren?t talking about giving cash as a gift to others, but the gift to yourself for buying your gifts in cash and not on credit. Right now is the perfect time to start budgeting your money for holiday gifts. Even if you are undecided as to what you want to give family or friends this year, you can begin to save money for that gift. Here is how:

  • Make a pledge to eliminate your luxury purchases for the next three months and save that money instead. Skip the Starbucks and put your money in a holiday gift fund.
  • Start cutting coupons, if you don?t already. Add up the money saved by using coupons put the difference into your holiday gift fund.
  • Look for gifts early. Many stores are already running sales on items that are typically bought during the holiday season.
  • Shop at more affordable stores. The dollar store is great for items that make great stocking stuffers. Resale and Goodwill stores can have great items at a fraction of the price.

I've been ranting about this all week, so I'm taking a few minutes to blog about it here. Hopefully it does a little bit of good.

By now, everyone knows that OMG clicking a link can maybe reset your Samsung phone and erase all your data!!!11!! Unfortunately, it's true for a good many phones out there, including about a jillion Galaxy S2 models. Like mine. While I'm the first to say that OEMs need to get off their ass and patch the phone of every user in the world that still has a contract or is under warranty, I also know that in the end, it's us -- the users -- that are responsible for our own security. 

For some, like me and many of you, that means getting out the data cable, giving the OEM and their jacked version of Android the finger and flashing a custom ROM that fixes bugs and exploits. There are plenty of AOSP builds already made for my Galaxy S2, and I'll be flashing at least one of them this evening. But some of us can't (or just don't want to) hack things up and deal with different bugs on unofficial firmware. That's cool, too. Not everyone is an idiot who likes to break willing to hack their expensive phone. That means you get to sit and wait for a patch that may never come. What can you do?

Here's a quick and dirty suggestion that will cut down on over 9,000-percent (totally made up figure) of exploits.

Can a plug-in change your politics?

The Balancer plug-in provides a cartoon character that indicates the balance of your browsing, from conservative red to liberal blue.

If you were told that your online reading habits lean toward the conservative or liberal side of the political spectrum, would you seek out more diversity? Or would you stick with the sources who agree with your point of view? Inquiring researchers want to know ??and to find out, they've created Balancer, a free plug-in for Google's Chrome browser.

"The top question that I'm most interested in is, can having real-time feedback about your online news reading habits affect the balance of the news that you read?" said Sean Munson, an assistant professor of human-centered design and engineering at the University of Washington.

Balancer determines whether your reading diet is fair and balanced by recording your visits to websites on a "whitelist" of 10,000 news sources and blogs. Each website has a rating on the liberal-to-conservative spectrum, typically based?on previous research ? for example, the studies that University of Chicago researchers Matthew Gentzkow and Jesse Shapiro have conducted on media bias and slant. (One of their studies, from 2010, rated the San Francisco Chronicle as the most liberal U.S. newspaper and the Washington Times as the most conservative.) Munson developed ratings for additional news sources, based on the other websites they linked to. (Yes, Cosmic Log is on the list, along with every other news website you've probably ever visited.)

When the Balancer plug-in is installed, a button is added to the browser bar that shows you a cartoon character balancing a conservative-red and a liberal-blue block on a stick. The comparative size of the blocks serves as an indication of how balanced your news diet is. If the stick is tilted way to one side, the cartoon will suggest websites from the other side that would bring your score into balance.

Some of the participants will get the verdict from Balancer right away; others will have to wait for a month while the plug-in gathers control data. That way, Munson and his colleagues can gauge the effect of real-time monitoring.

Personality profile
There's one more data-mining twist: When you sign up for the plug-in, you'll be asked a set of questions about personality attributes: Do you consider yourself liberal or conservative? Are you the life of the party? Do you often forget to put things back in their proper place? The answers to such questions add a dimension to Munson's research.

"It's possible that different personality attributes predict reading behavior, as well as how amenable someone is to being persuaded to change reading habits," he told me. "We have found that some people do in fact seek out diversity, but there are also some people who are 'diversity-challenged' when it comes to online news reading."

The plug-in was developed at the University of Michigan, where Munson earned his doctorate, and works only with the Chrome Web browser. It misses out on anything you read via other browsers, including mobile apps. Funding for the project came from the National Science Foundation.

When Munson put his own reading habits to the test, he was surprised to find out how slanted his news diet turned out to be. So he's curious to find out how inclined other people might be to change their ways. "Even self-discovery is a valuable outcome, just being aware of your own behavior," he said in a news release. "If you do agree that you should be reading the other side, or at least aware of the dialogue in each camp, you can use it as a goal: Can I be more balanced this week than I was last week?"

Of course, most people probably think they're already fair and balanced, no matter how their political views look from the outside. So far, a few dozen people have signed up for the Balancer experiment, but Munson and his colleagues hope to sign up many more between now and the November elections.

Eventually, Munson's findings may influence the design of online search engines and recommendation websites. Today, your browser may ask if you're "feeling lucky." Someday, it just might ask if you feel like hearing a different opinion.

But wait, there's more:
By now, you're probably asking, "What about privacy?" A browser plug-in that keeps track of your reading habits and matches them up with your personality may sound like a big wet kiss for Big Brother. Munson's aware of the concern: He said the plug-in has been designed to anonymize all the data coming in, and will only keep track of the sites on the 10,000-website whitelist. Any other data ? including records of your visits to the naughty parts of the Internet???will go no farther than your own computer, he said.

"We did that partly to minimize the traffic on our servers, and also to protect privacy," Munson told me. "We've tried to collect as little data as necessary for the study."

Mauritius' Lux Resorts pretax hurt by financing costs

PORT LOUIS (Reuters) - Mauritius hotels group Lux Island Resorts posted a drop in pretax profit for the year ended June to 14.26 million rupees from 45.95 million a year before, reflecting higher finance costs, it said on Friday.

The luxury hotel group, which has properties in the Maldives and Reunion islands as well as on the Indian Ocean island itself, said occupancy rates rose by 1 percentage point to 72 percent.

Revenue increased to 3.71 billion rupees from 3.10 billion and earnings per share climbed to 0.24 rupees from 0.07, the company said in a statement.

"With regard to the current low season, we are experiencing negative growth, however management has contained costs and maximised efficiencies and we expect earnings ... to approximate that of last year," Lux said in a statement.

The results were issued after the market closed. Shares of the firm had closed the session unchanged at 15 rupees.

Texas Weighs the Value of Sentiment in Pet Death ... - Life With Cats

Texas may soon see an upgrade in the legally established value of the lives of the state?s pets. While companion animals are still considered property, a 2nd court ruling accepted the argument that we place a great sentimental value on the lives of our pets, who, through our relationships with them, are worth more than their replacement value. The case will go before the state Supreme Court; it? involves a family?s dog, but the outcome of the case is of equal importance to cat owners.

FORT WORTH (CN) ? The Texas Supreme Court has agreed to hear a closely watched case over whether dog owners can sue for sentimental value rather than market value of their dead pet.

The court agreed to hear the case after defendant Carla Strickland, a former Fort Worth animal shelter employee, appealed a November ruling by the state?s 2nd Court of Appeals that allowed plaintiffs Kathryn and Jeremy Medlen to pursue negligence claims against her.
According to court filings, their 8-year-old Labrador mix, Avery, escaped from the Medlens? back yard and was picked up by the city?s animal control.

Jeremy Medlen went to the shelter to bail out Avery, but did not have enough cash in hand to pay the fees. He was told he could return the next day and that a hold-for-owner tag would be placed on Avery?s cage, to prevent him from being euthanized. But Avery was killed the next day before the Medlens could pick him up.

The Medlens sued for ?sentimental or intrinsic? damages; Strickland objected, saying such damages are not recoverable for the death of a dog.
The First Tarrant County Court at Law then dismissed the suit for failure to state a claim for damages recognized by law. The court said the Medlens could recover only the market value of the dog, in line with a 120-year-old Texas Supreme Court ruling, Heiligmann v. Rose, 81 Tex. 222, 16 S.W. 931 (Tex. 1891).

The Medlens appealed to the 2nd Court, which reversed and concluded that although the state?s highest court had not dealt directly with the value of a lost pet since that ruling, ?it has explicitly held that where personal property has little or no market value, and its main value is in sentiment, damages may be awarded based on this intrinsic or sentimental value.?

?Because an owner may be awarded damages based on the sentimental value of lost personal property, and because dogs are personal property, the trial court erred in dismissing the Medlens? action against Strickland,? the court wrote.

The Medlens? attorney Randy Turner told the Fort Worth Star-Telegram after the 2nd Court?s ruling this is the first time in Texas that someone can sue for a pet?s sentimental value.

?No matter how attached they were to their pet, and no matter how devastated they were by its death ? they (had been) only entitled to the ?market value? of the animal,? Turner told the Star-Telegram.

Strickland?s attorney, Paul Boudloche, told Texas Lawyer that ?our position is the law has been settled for 120 years not only by the Supreme Court but by the court of appeals. And the decision by the 2nd Court took us totally by surprise.?

?I think it?s going to have a significant impact on the private sector, particularly veterinarians, kennel owners, even individuals who take care of their neighbors? pets. I mean, for example, on veterinarians, things which would be routine care for a pet, now they have to practice much more defensive medicine,? Boudloche said. ?[T]he value of a dog has changed in the eye of the law. So, if mistakes happen, the exposure for everybody is much greater.?Oral arguments are scheduled for January 10.

EU wants $12B a year from US over Boeing aid

BRUSSELS (AP) ? The European Union said Thursday it is asking the World Trade Organization to impose up to $12 billion per year in sanctions on the U.S. as part of a long-running dispute involving government subsidies to plane-makers Airbus and Boeing.

The EU said in a statement the amount was "based on estimates of the damages suffered by the EU due to unfair and biased competition from the U.S. industry," which received U.S. government subsidies.

The action marks the latest salvo in a seven-year dispute between the EU and the U.S. over subsidies to the two plane-makers.

Officials from France, where Airbus is based, welcomed the EU's decision.

"The aerospace companies need to have a level playing field in international competition," Foreign Trade Minister Nicole Bricq and Transport Minister Frederic Cuvillier said in a statement. "This conflict has gone on too long now. We must put an end to it and restore fair competition. It is important for European companies and jobs. "

An Airbus spokeswoman also praised the EU decision.

"But this is nothing other than the next step in a trade dispute initiated in 2004 by Boeing. ..." Maggie Bergsma said. "We regret that Boeing continues a legal battle that could have been resolved a long time by mutual agreement.

A spokesman for Boeing said the company had no immediate reaction to the EU's decision to seek sanctions, but referred to a statement the company made Sunday when the U.S. issued a statement saying it had complied with the WTO ruling in the case.

The Boeing statement then endorsed the U.S. government statement and sharply criticized Europe and Airbus.

While the U.S. had complied, the statement said, "the same cannot be said of Airbus and its government sponsors, which have thumbed their noses at the WTO. Despite a crystal clear ruling against launch aid subsidies, European governments have continued the practice by providing Airbus with billions of taxpayer euros and pounds for its next new product, the A350. What is more, the European governments have yet to remove the very substantial subsidies, including those propping up the A380, which the WTO's ruling in June of last year requires them to do."

Boeing Co. and Airbus are fighting over a market believed to be worth more than $3 trillion over the next decade. The WTO has found fault on both sides.

In March, a WTO appeals panel upheld an earlier finding that Boeing received at least $5 billion in subsidies that hurt its European archrival and were prohibited under international trade rules. The amount, though, was far less than the European Union had alleged in its complaint.

On Monday, the U.S. claimed it had complied with that ruling by stopping some payouts to Boeing through NASA and the Pentagon and by removing some beneficial tax and funding policies.

The EU has rejected those claims.

Still, it has not emerged unscathed from the dispute, either. A WTO panel has ruled that European governments provided $18 billion in subsidies to Airbus, though not all were deemed illegal.

Giant ferris wheel to offer view of New York City landscape

NEW YORK (Reuters) - A plan to build the world's tallest ferris wheel on New York's Staten Island, offering sweeping views of the Manhattan skyline, could hold the answer to a long-elusive goal: putting the most-overlooked of city's five boroughs on the tourist map.

The giant ferris wheel, at 625 feet, will be about half the height of the Empire State Building and taller than Singapore's Flyer and the planned "High Roller" wheel in Las Vegas, the city said.

Similar to the London Eye, visitors will ride in thirty-six capsules, each able of carrying up to 40 passengers - or 1,440 people per cycle.

The city estimates the observation wheel - which will stay open every day of the year except during severe weather - will attract 30,000 riders a day during the peak season and 4.5 million visitors per year. It is expected to open in 2015.

The wheel will stand near the Richmond County Bank Ballpark and the Staten Island Ferry terminal, the base of a free water taxi that travels across New York Harbor between the skyscrapers of lower Manhattan and Staten Island. The wheel will anchor a retail complex with 100 designer outlet stores, theater space, a hotel, restaurants and cafes.

"It will offer unparalleled and breathtaking views, and is sure to become one of the premier attractions in New York City and the latest exciting addition to our newly revitalized waterfront," New York mayor Michael Bloomberg said in a statement

The project, developed by New York Wheel and BFC Partners, is part of Bloomberg's larger effort to develop the city's extensive waterfront with parks and recreational projects and make the city more tourist-friendly.

It will create 1,200 construction jobs and 1,100 permanent jobs, and pump $500 million in private investment into the borough's waterfront, according to city estimates.

Staten Island Borough President James Molinaro said in a statement the project would be a "game changer for the borough, which is perhaps best known for hosting the Fresh Kills landfill - once the city's principal dump and later a sorting ground for rubble from the September 11, 2001 World Trade Center attacks.

As Molinaro told the local Staten Island Advance newspaper: "We've gone from having the world's biggest dump to having the world's biggest wheel."

Belichick fined 50K, Kyle Shanahan 25K by NFL

NEW YORK (AP) ? The NFL fined New England Patriots coach Bill Belichick $50,000 and Washington Redskins assistant Kyle Shanahan $25,000 on Wednesday for their conduct toward replacement officials.

The fines come as the league and its referees' union were meeting amid reports they were close to ending the lockout of the regular officials.

Belichick grabbed an official's arm at the end of Sunday night's game after the Ravens kicked a winning field goal. Shanahan was cited by the league for "abuse of officials" in Washington's loss to Cincinnati.

"It was inappropriate for me to contact the official. I take responsibility for what happened," Belichick said in statement released by the team. " I accept the discipline and I apologize for the incident Sunday night in Baltimore."

Shanahan, the son of Redskins coach Mike Shanahan, was called for unsportsmanlike conduct for berating officials in the final seconds of the Redskins' 38-31 loss. He also confronted an official in a stadium tunnel after the game.

"Any time you do what he did you're going to get fined, and that's the nature of the game," Mike Shanahan said. "If you don't abide by the rules, you're going to pay a penalty and usually after a guy pays 25 grand, they usually learn very quickly."

Also, the NFL said Baltimore Ravens coach John Harbaugh won't be fined for making contact with a game official during Sunday's 31-30 win over New England. Ray Anderson, the NFL's vice president of football operations, said Harbaugh did not violate the rule regarding abuse of officials.

On Monday, the league fined Broncos coach John Fox $30,000 and defensive coordinator Jack Del Rio $25,000 for berating officials during a loss to Atlanta on Sept. 17.

Canadians, Chinese buying into the American Dream

Among all foreign browsers of Realtor.com, Canadians rank No. 1, routinely checking out Miami, Fort Lauderdale and Orlando, according to data provided by the website.

With many U.S. consumers still lukewarm about buying into the American dream, Canadians, Chinese and Mexicans are burning up Realtors? cell phones and emails, grabbing up swank vacation nooks, secure places to stash their cash, or just old-fashioned bargains.

Foreign purchases of U.S. homes have climbed by 24 percent since 2011, reports the National Association of Realtors, reaching $82.5 billion in total annual sales,?and helping brace once-creeky markets like Miami.

?They love the U.S. because their money is safe here. Even if they only break even on a property, they know they can get their money out,? said Matey Veissi, broker-owner with Veissi & Associates in Miami. She estimates that 35 to 40 percent of her firm?s business is conducted with foreign buyers. ?South Beach and Miami Beach are popular with the Brazilians ? they like the water. The west coast of Florida is popular with the Europeans because it?s quieter. The Canadians like the middle of the state.?

But even as residential prices perk up in many U.S. cities, international interest in American homes is expected to hold firm ? simply because with many international buyers, it?s not all about the dollar signs, said Jed Smith, an NAR economist.

As with some American homebuyers, it?s also about status.

?Foreigners purchase for a variety of reasons: trophy homes, desire to put money in the U.S. for safety, desire to have a place to visit for vacation, desire for a rental unit,? Smith said, adding that about half of those buyers move to the United States. ?These factors ? tend to dampen the effects of changes in total overall cost."

Case in point: Miami, where home values bumped 2.1 percent higher from June to July, according to the S&P Case-Shiller index released Tuesday.??That?s very much an international city that tends to attract people from a variety of places who also have quite a bit of money and who are looking to make a statement,? Smith said.

Through March 2011 to March this year, Canadians led the international housing invasion, comprising 24 percent?of foreign sales, or about $16 billion in collective purchases, Smith said.

For Canadians, proximity is the prime enticement to buy American and many seem drawn to the balmy breezes of Florida, said Steve Berkowitz, CEO of Realtor.com, operator Move, Inc.

?A second home in the U.S. provides a relatively inexpensive way for Canadians to escape snowy weather and below-freezing temperatures,? Berkowitz said.

Among all foreign browsers of Realtor.com, Canadians rank No. 1, routinely checking out Miami, Fort Lauderdale and Orlando, according to data provided by the website.

?One of the things about international purchases: Once that community gets established in that area, it tends to attract like people from that community,? said NAR?s Smith. ?So the Canadians have been coming to those areas for quite a while.?

Chinese consumers also are frequent visitors to Realtor.com, virtually exploring neighborhoods in Los Angeles and San Francisco, the site reports. Chinese comprised 11 percent of all international transactions from March 2011 to this past March ? forming the second-largest group of foreign buyers and spending about $9 billion during that span on American housing, according to NAR.

Income levels largely drive the consumer tastes of Chinese house hunters, experts say.

?On the West Coast, you might have five or 10 families from China who pool their resources to purchase something, have a student live in it and then rent out the rooms. At the end of the student?s time, hopefully they sell the place for a capital gain. Those are the middle-class Chinese, buying for an investment,? Smith said. ?There are also a fair number of wealthy people in China who are buying for a major second home.?

In San Francisco, upscale high-rises that have attracted venture capitalists and members of the San Francisco 49ers now are drawing affluent Chinese residents, said Realtor Matt Fuller. Such plush condo buildings include Millennium Tower ? which boasts three sets of concierges and a salt-water pool ? and One Rincon Hill where, he said, prices can touch seven figures. Those exclusive, residential spires are relatively new to the Bay Area, he added.

?It?s hard to say if the number of Chinese buyers is increasing because we have more interest (from China) or if we?re noticing this trend because this is a style of construction and a level of service that we didn?t used to have here,? Fuller said.

Those elite addresses are fancied by British buyers as well, Fuller said.?Online shoppers from the United Kingdom comprise one of the thickest clumps of foreign lookie-loos at Realtor.com. They?ve also been checking out Los Angeles, Orlando and Las Vegas, according to the site?s stats.

McMansions favoured
And when they do peruse American real estate online, the Brits ? like many other Europeans ? tend to click on larger ?McMansions,? said Jed Kolko, chief economist at Trulia. After reviewing user trends at that real estate website, Kolko noticed that Dutch consumers check out the biggest American abodes, with a median size of 2,400 square feet, followed closely by U.K. consumers, whose targeted homes have a median size of 2,342 square feet.

Americans who use Trulia examine properties with?a median size of 1,854 square feet.

?The rest of the world might make fun of Americans for our big portions, big homes and big butts, but it turns out that most foreigners look at bigger homes than what most Americans look at ? among all searches of U.S. homes on Trulia,? Kolko wrote in a blog last week.

By comparison, Mexican consumers who tap Trulia?s listings are focused on even smaller homes ? those with a median size of 1,794 square feet, Kolko reported.?

But Mexicans currently spend about $6.5 billion a year on U.S. homes, NAR says, ranking Mexico at No. 3 among the nations that lately have been gobbling up American properties.

?They are focused heavily on proximity, namely Texas,? Smith said. ?They?re buying mainly for safety as well as for a better environment. ?There?s been quite an influx of Mexican money into this country in recent years just based on the safety issues in that country.?

On Realtor.com, Mexicans have been inspecting homes in San Antonio and Laredo, Texas, the site reports.

And in Miami, one Mexican client taught Realtor Veissi just how careful people in that country have become about protecting their monetary secrets. Although Veissi was representing that Mexican family in its house search, her description of the artful process sounds like it involved all the cunning of a big-stakes poker game.

?They started with a price point of $250,000 and asked me about the price of eggs and milk here,? Veissi said. ?They led me to believe they were on a budget. Then they gradually increased the price (for their hunt), which I found interesting, and ended up with a home at close to $1 million.

?They don?t want to tell you a lot about their finances unless they know you better. Initially, they didn?t trust me. Most Americans don?t have any patience with that,? she added. ?But when you develop the relationship, you get the entire family, their friends, everyone they?re connected with (as future clients). It just takes a long time to develop that trust.??
